So what you're saying is, Person A submits a name to a contest, Person B submits the same name to Instant Domains 10 days later, CH chooses the name, who gets the money?
Well, Person B couldn't have seen the name Person A submitted unless it won a contest. If it won a contest and he saw the name, how could he submit it to Instant Domains? So, Person B was probably unaware of the prior submission. The person who gets the money would be whoever submitted the name to the contest. Doesn't the system only allow the submission of any name once? Are you saying that there is a loophole where one name can be submitted twice to a contest?
